{"id":54541,"date":"2020-12-10T13:35:16","date_gmt":"2020-12-10T18:35:16","guid":{"rendered":"https:\/\/sustainableagriculture.net\/?p=54541"},"modified":"2020-12-10T16:37:22","modified_gmt":"2020-12-10T21:37:22","slug":"release-fair-competition-livestock-rule-fails-to-advance-needed-reforms","status":"publish","type":"post","link":"https:\/\/sustainableagriculture.net\/blog\/release-fair-competition-livestock-rule-fails-to-advance-needed-reforms\/","title":{"rendered":"RELEASE: Fair Competition Livestock Rule Fails to Advance Needed Reforms"},"content":{"rendered":"\n<p><strong>Contact: Eric Deeble, Policy Director<br>National Sustainable Agriculture Coalition<br>edeeble@sustainableagriculture.net<\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-text-align-center\"><strong>Fair Competition Livestock Rule Fails to Advance Needed Reforms<\/strong><br><em>USDA fails to address major issues with its \u201cundue preference\u201d rule<\/em><\/p>\n\n\n\n<p><em>Washington, DC, December 10th,\u00a02020\u00a0<\/em>\u2013 Today, the United States Department of Agriculture\u2019s Agricultural Marketing Service (AMS) released a final rule to attempt to satisfy <a rel=\"noreferrer noopener\" href=\"https:\/\/sustainableagriculture.net\/blog\/undue-preference-gipsa\/\" target=\"_blank\">2008 Farm Bill requirements<\/a> to create criteria for determining whether meat packers give undue or unreasonable preference or advantage to one producer over another. <\/p>\n\n\n\n<p>\u201cThe rule fails to advance any meaningful reforms to address the abusive and exploitative practices conducted by these corporations for decades,\u201d said Eric Deeble, Policy Director at the National Sustainable Agriculture Coalition. \u201cWe are counting on the new incoming Biden-Harris Administration and the incoming Secretary of Agriculture to not only rescind the Trump Administration rule, but to also bring back all of the <a rel=\"noreferrer noopener\" href=\"http:\/\/sustainableagriculture.net\/blog\/usda-farmer-fair-practice-rules\/?emci=1e675235-be33-ea11-a1cc-2818784d084f&amp;emdi=ea000000-0000-0000-0000-000000000001&amp;ceid=%7B%7BContactsEmailID%7D%7D\" target=\"_blank\">\u2018Farmer Fair Practices Rules\u2019<\/a> and ensure that those previous rules are improved upon.\u201d\u00a0\u00a0<\/p>\n\n\n\n<p>This rulemaking is part of the directive in the 2008 Farm Bill instructing USDA to establish criteria under the Packers and Stockyards Act of 1921.<\/p>\n\n\n\n<p>AMS made minimal changes to the four criteria in the <a href=\"http:\/\/sustainableagriculture.net\/blog\/comment-new-fair-competition-rules-for-livestock-and-poultry-industry-advanced\/\" data-type=\"URL\" data-id=\"sustainableagriculture.net\/blog\/comment-new-fair-competition-rules-for-livestock-and-poultry-industry-advanced\/\" target=\"_blank\" rel=\"noreferrer noopener\">January 2020 proposed rule. <\/a>This final rule does not include other important aspects of undue preference, such as harm to competition and retaliation or a farmer\u2019s right to speak out about harmful practices.<\/p>\n\n\n\n<p>The<a href=\"http:\/\/public-inspection.federalregister.gov\/2020-27117.pdf\" data-type=\"URL\" data-id=\"public-inspection.federalregister.gov\/2020-27117.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"> undue preference rule<\/a> is only a small part of a larger package of proposed rules advanced under the Obama Administration under USDA Secretary of Agriculture Tom Vilsack at the end of 2016, known as the \u201cFarmer Fair Practices Rules\u201d.
