Amidst final-hour congressional negotiations to fend off a government shutdown, several policy \u201criders\u201d have emerged as sticking points in reaching a deal on agriculture spending in particular. A \u201c<a href=\"https:\/\/www.senate.gov\/about\/research-tools\/glossary.htm#R\" target=\"_blank\" rel=\"noreferrer noopener\">rider<\/a>\u201d refers to a non-germane legislative provision tacked onto a must-pass appropriations bill.<\/p>\n\n\n\n<p>The House of Representatives\u2019 FY24 Agriculture Appropriations bill \u2013\u00a0initially unveiled almost a year ago, in early spring 2023 \u2013 <a href=\"https:\/\/sustainableagriculture.net\/blog\/house-fy24-appropriations-draft-undermines-farmers-and-food-system\/\" target=\"_blank\" rel=\"noreferrer noopener\">includes a number of harmful policy riders<\/a> on top of deep funding cuts. This post briefly examines several proposed policy riders as Congress seeks to conclude FY24 appropriations negotiations.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Limiting Fair Competition<\/strong><\/h3>\n\n\n\n<p>One such policy rider, related to the implementation of rules associated with the Packers and Stockyards Act (P&amp;SA), would effectively prevent the USDA from promoting fair market competition for livestock and poultry growers, both now and in the future. The P&amp;SA was passed in 1921 <a href=\"https:\/\/contractagreform.org\/a-brief-history-of-corporate-power-in-animal-agriculture\/\" target=\"_blank\" rel=\"noreferrer noopener\">to combat anticompetitive practices<\/a> in the livestock and poultry industries as corporate meatpackers and processors (also known as integrators) consolidated and amassed substantial power over producers. Enforcement waned over time and in 2019, almost a century later, <a href=\"https:\/\/www.ers.usda.gov\/webdocs\/publications\/106795\/eib-256.pdf?v=3888.5\" target=\"_blank\" rel=\"noreferrer noopener\">just four companies<\/a> processed 85 percent of beef, 67 percent of pork, 53 percent of chicken, and 55 percent of turkey.\u00a0<\/p>\n\n\n\n<p>Congress directed USDA to modernize the P&amp;SA in recognition of this unprecedented market consolidation in the 2008 Farm Bill. But for 15 years, <a href=\"https:\/\/sustainableagriculture.net\/blog\/undo-the-packers-and-stockyards-undue-preference-final-rule\/\" target=\"_blank\" rel=\"noreferrer noopener\">each attempt by any Administration to act on this mandate has stalled<\/a>. Members of Congress opposed to P&amp;SA reform consistently <a href=\"https:\/\/sustainableagriculture.net\/blog\/whats-all-the-flapping-about\/\" target=\"_blank\" rel=\"noreferrer noopener\">included riders to annual appropriations bills<\/a> that obstructed USDA\u2019s ability to make progress.<\/p>\n\n\n\n<p>In 2021, the Biden Administration <a href=\"https:\/\/sustainableagriculture.net\/blog\/livestock-and-poultry-competition-reform-on-the-horizon\/\" target=\"_blank\" rel=\"noreferrer noopener\">announced a renewed directive<\/a> for USDA to strengthen the P&amp;SA in alignment with an <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/07\/09\/fact-sheet-executive-order-on-promoting-competition-in-the-american-economy\/\" target=\"_blank\" rel=\"noreferrer noopener\">Executive Order on Promoting Competition in the American Economy<\/a>. USDA announced a final rule on <a href=\"https:\/\/sustainableagriculture.net\/blog\/release-nsac-celebrates-final-rule-promoting-transparency-for-contract-poultry-growers\/\" target=\"_blank\" rel=\"noreferrer noopener\">promoting transparency for contract poultry growers<\/a> in 2023 and is expected to soon finalize a proposed rule that <a href=\"https:\/\/sustainableagriculture.net\/blog\/release-new-usda-proposed-rule-to-give-livestock-and-poultry-growers-fair-shake\/\" target=\"_blank\" rel=\"noreferrer noopener\">protects producers from anticompetitive discriminatory and predatory practices<\/a>.\u00a0\u00a0<\/p>\n\n\n\n<p>Now, some members of Congress have revived a decade-old strategy to oppose modernization of the P&amp;SA that would promote fair market competition for livestock and poultry growers. Active riders to the FY24 appropriations bill in the House would not just undo USDA\u2019s recent and ongoing rulemaking. They would also prevent USDA from strengthening the P&amp;SA in the future. This would be a devastating blow to the many livestock and contract poultry growers trapped in an anticompetitive industry or in hostile arrangements with integrators.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Chairman of the House Appropriations Subcommittee on Agriculture, Representative Andy Harris (R-MD-01), has made the inclusion of this rider a top priority to advance the spending bill to the House floor. The National Farmers Union <a href=\"https:\/\/nfu.org\/wp-content\/uploads\/2024\/02\/02-13-2024-Letter-Oppose-FY24-PSA-Rider.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">delivered a joint letter<\/a> to the House Appropriations Committee leadership earlier this month in opposition to these riders. NSAC and a number of member and allied organizations were signatories to the letter. In addition, Senators Grassley (R-IA) and Tester (D-MT), both farmers, recently <a href=\"https:\/\/www.tester.senate.gov\/wp-content\/uploads\/2024-02-20-Tester-and-Grassley-Dear-Colleague-re-PS-Riders.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">penned a letter to colleagues<\/a> lauding the importance of a stronger P&amp;SA to protect farmers and ranchers and urged members of Congress to oppose any such riders.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Hampered Response to Emergent Agricultural Needs<\/strong><\/h3>\n\n\n\n<p>Another proposed rider seeks to restrict USDA\u2019s ability to direct Commodity Credit Corporation (CCC) resources toward emergent agricultural needs. This in turn could deal significant blows, both now or in the future, to initiatives such as the <a href=\"https:\/\/fas.usda.gov\/programs\/regional-agricultural-promotion-program\" target=\"_blank\" rel=\"noreferrer noopener\">Regional Agricultural Promotion Program<\/a>, the <a href=\"https:\/\/www.ams.usda.gov\/services\/grants\/omdg\" target=\"_blank\" rel=\"noreferrer noopener\">Organic Market Development Grants<\/a>, the <a href=\"https:\/\/www.rd.usda.gov\/programs-services\/business-programs\/fertilizer-production-expansion-program\" target=\"_blank\" rel=\"noreferrer noopener\">Fertilizer Production Expansion Program<\/a>, the <a href=\"https:\/\/sustainableagriculture.net\/blog\/report-illustrates-initial-success-of-local-food-purchasing-agreements\/\" target=\"_blank\" rel=\"noreferrer noopener\">Local Food Purchase Assistance Program<\/a>, and the <a href=\"https:\/\/sustainableagriculture.net\/blog\/who-benefits-a-look-at-the-partnership-for-climate-smart-commodities-preliminary-awards\/\" target=\"_blank\" rel=\"noreferrer noopener\">Partnerships for Climate-Smart Commodities<\/a>.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/www.usda.gov\/ccc\" target=\"_blank\" rel=\"noreferrer noopener\">CCC<\/a> is the mandatory funding mechanism for many federal agricultural programs.\u00a0 A wholly owned corporation of the United States government, the CCC was created during the New Deal and put into its current statutory framework in 1948.\u00a0 The CCC is used to fund commodity, conservation, bioenergy, and trade programs included in the periodically re-authorized federal farm bill.\u00a0<\/p>\n\n\n\n<p>The House\u2019s FY2024 Agriculture Appropriations bill proposed a restriction on the discretionary use of the CCC, and depending on the precise policy language, this rider could significantly hamper USDA\u2019s ability to respond to emerging agricultural needs. Ultimately, the bottom line is that any inclusion of language that would hinder the Secretary of Agriculture\u2019s flexibility to respond to emerging needs, such as the fracturing of supply chains during the COVID-19 pandemic, has the potential to impact the continued delivery of programs that address acute regional and nationwide needs.&nbsp;<\/p>\n\n\n\n<p>For example, the USDA made additional funding available to the Local Food Purchase Assistance Program (LFPA) in November 2022 to maintain and improve regional agricultural supply chains. Through cooperative agreements with States, Tribal governments, and territories, LFPA strategically leverages CCC funds to create economic opportunity for local producers and underserved farmers, build local food supply chains, and address food insecurity. This additional funding offers an opportunity to <a href=\"https:\/\/sustainableagriculture.net\/blog\/report-illustrates-initial-success-of-local-food-purchasing-agreements\/\" target=\"_blank\" rel=\"noreferrer noopener\">build on the program&#8217;s initial success<\/a>, with projected estimates of more than $1.5 billion in local economic impact.\u00a0<\/p>\n\n\n\n<p>Recently, 153 regional LFPA implementers and stakeholders across the nation <a href=\"https:\/\/sustainableagriculture.net\/wp-content\/uploads\/2024\/02\/FY24-Appropriations-LFPA-Letter-February-20-2024.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">delivered a letter<\/a> to Congressional leadership to express their strong opposition to any rider that restricts the Secretary\u2019s current authority to utilize CCC funds.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Other Threats&nbsp;<\/strong><\/h3>\n\n\n\n<p>Beyond these threats, the <a href=\"https:\/\/sustainableagriculture.net\/blog\/house-fy24-appropriations-draft-undermines-farmers-and-food-system\/\" target=\"_blank\" rel=\"noreferrer noopener\">House bill also includes<\/a> several riders that would block USDA from carrying out a variety of its racial equity-focused initiatives, including anything related to Executive Orders <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2021\/01\/20\/executive-order-advancing-racial-equity-and-support-for-underserved-communities-through-the-federal-government\/\" target=\"_blank\" rel=\"noreferrer noopener\">13985<\/a>, <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2021\/06\/25\/executive-order-on-diversity-equity-inclusion-and-accessibility-in-the-federal-workforce\/\" target=\"_blank\" rel=\"noreferrer noopener\">14035<\/a>, and <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2023\/02\/16\/executive-order-on-further-advancing-racial-equity-and-support-for-underserved-communities-through-the-federal-government\/\" target=\"_blank\" rel=\"noreferrer noopener\">14091<\/a>, or the creation and establishment of an Office of the Chief Diversity and Inclusion Officer. This rider, like the others, is counter to NSAC\u2019s mission and vision.<\/p>\n\n\n\n<p>As Congress seeks to resolve FY24 Appropriations negotiations in the coming days, numerous riders &#8211; each of which carries their unique negative impacts &#8211; continue to be debated. NSAC believes including any of the aforementioned riders would lead to a less just and resilient food and farm system.
